Terms & Conditions
1. About the Raffle and Promoter
1.1 Buxton Opera House Grand Winter Raffle 2026-27 (“the Raffle”) is promoted by High Peak Theatre Trust Limited (Registered Charity No. 507354; Company No. 1356378, “the Promoter”). The Promoter is registered in England and Wales and its registered office is No. 5 The Square, Buxton, Derbyshire, SK17 6AZ. The Promoter is registered with High Peak Borough Council to operate a small society lottery under the Gambling Act 2005, Lottery Registration No. HPKSL0287. The Responsible Person is Tara Hill, who can be contacted at the above address, or reached via development@boh.org.uk or on 01298 211241.
2. Who can enter
2.1 The Raffle is open only to individuals aged 18 or over who are physically located in Great Britain, meaning England, Scotland or Wales, when purchasing their entry. Entries must not be purchased from Northern Ireland, the Channel Islands, the Isle of Man or any other location outside Great Britain. Tickets must not be purchased by, sold to, on behalf of, or for the benefit of anyone under 18. Where the Promoter reasonably believes that an entry has been purchased in breach of this condition, the entry will be void, the person will not be entitled to a prize, and the Promoter will return the entry price to the original payment method where reasonably practicable. The Promoter may require proof of age and identity before awarding a prize.
2.2 Employees, Trustees, Volunteers and Freelance Staff/Performers of Buxton Opera House may enter the Raffle, except for any person directly involved in the administration or conduct of the relevant draw. Members of the immediate household of anyone directly involved in conducting the draw are also ineligible to enter that draw.
2.3 By purchasing an entry, each entrant confirms that they meet the eligibility requirements and agrees to be bound by these Terms and Conditions, including Appendix 1.
3. How to enter
3.1 To enter the Raffle, an eligible individual must purchase one or more £2 entries online through the Buxton Opera House website or in person or by telephone from the Box Office before the closing date.
3.2 The cost of each entry is £2. There is no individual purchase limit, subject to availability and the overall maximum of 10,000 entries. The Promoter may refuse or cancel a transaction where it reasonably suspects fraud, payment failure, automated purchasing, a breach of these Terms and Conditions, or activity creating a legal or regulatory risk.
3.3 Raffle entries cannot ordinarily be cancelled or refunded after purchase. This does not affect any rights that cannot lawfully be excluded and does not prevent the Promoter from issuing a refund where the Raffle is cancelled, a payment has been duplicated because of a technical error, or an entry has been accepted in error. Refunded or reversed entries will be void and excluded from the draw. Where a transaction includes multiple entries and is refunded in full, all entry numbers associated with that transaction will be void.
3.4 The Promoter is not responsible for entries that are lost, delayed, misdirected, incomplete or not received because of postal failure, equipment failure, technical malfunction, network failure or another circumstance outside the Promoter’s reasonable control.
3.5 For online purchases, a Spektrix electronic ticket constitutes the entrant’s raffle ticket. For entries purchased in person, a ticket will be provided. Entrants should retain their ticket as proof of purchase. An entry will be included in the draw only once full payment has been received and accepted by the Promoter.
4. Opening, closing and draw dates
4.1 The raffle will open at 10am UK time on Thursday 1 October 2026 and close at 10.59am UK time on Monday 25 January 2027. Entries received outside of this time period will not qualify to be entered into the Raffle. The draw will take place at 12pm UK time on 25 January 2027.
5. Selecting and contacting winners
5.1 Each valid paid entry will be assigned a unique entry number. Winners will be selected using a verifiably random computer process from the complete list of valid entry numbers. The draw will be conducted by the Head of Development and witnessed by at least two people, including at least one person who has not been involved in administering the Raffle and is not eligible to enter. The Promoter will retain an audit record of the eligible entries, the draw process, the winning and reserve entry numbers, the date and time of the draw, and the witnesses present.
5.2 The Promoter will make reasonable attempts to contact each provisional winner using the details supplied at the time of purchase, normally within seven days and no later than 14 days after the draw. The Promoter may use email, telephone and post. Entrants are responsible for ensuring that their contact details are complete and accurate. A person will not become a confirmed winner until their eligibility has been verified. The Promoter will select an ordered list of reserve winning entry numbers during the original draw. If a provisional winner does not respond within 14 days, is ineligible, declines the prize or breaches these Terms and Conditions, the prize will be offered to the next applicable reserve winner.
5.3 To demonstrate that a valid award has taken place, the Promoter intends to publish or make available the surname and county of each prize winner for a limited period after the draw. Entrants may object to this information being published or may request that the amount of information published be reduced. Any objection should be made when the winner is notified. The Promoter may still provide winner information and evidence of the award to the Advertising Standards Authority, High Peak Borough Council, the Gambling Commission or another competent authority, where required.
6. Prizes
6.1 Six winning entry numbers will be drawn and prizes will be allocated in the order shown in Appendix 1, beginning with the first prize. Once an entry number has won a prize, that entry number will be removed from subsequent draws. Other valid entry numbers belonging to the same entrant will remain eligible, so an entrant who has purchased more than one entry may win more than one prize.
6.2 Prizes are non-exchangeable, non-refundable and not redeemable for cash or another prize. A prize may be transferred to another eligible individual only where Appendix 1 and the relevant prize supplier permit this and with the Promoter’s prior agreement. The recipient must meet all applicable eligibility requirements and comply with the relevant prize conditions. Prizes must not be sold, auctioned or otherwise exchanged for financial gain.
6.3 If circumstances outside the Promoter’s reasonable control make an advertised prize unavailable, the Promoter may substitute a prize of equal or greater value and reasonably comparable character.
6.4 Unless expressly stated otherwise in Appendix 1, travel, accommodation, meals, refreshments, equipment, insurance and other costs associated with accepting or using a prize are not included.
6.5 The prizes available in the Raffle are described in Appendix 1: Prize Schedule and Prize-Specific Conditions. Appendix 1 forms part of these Terms and Conditions. Each prize is subject to the eligibility requirements, availability, redemption deadlines, booking requirements, exclusions and supplier terms stated in Appendix 1. Entrants should review the applicable prize conditions before purchasing an entry.
7. Personal Data
7.1 The Promoter will process entrants’ personal data for the purposes of taking payment, administering entries, conducting and auditing the draw, contacting and verifying winners, delivering prizes, meeting legal and regulatory obligations, preventing fraud and handling queries or complaints. The Promoter uses Spektrix to process ticket transactions and administer booking information. Personal data will be handled in accordance with the Buxton Opera House Privacy Policy (https://buxtonoperahouse.org.uk/privacy-policy/). Purchasing a Raffle entry does not constitute consent to receive marketing/fundraising communications. Any marketing/fundraising preference will be collected separately and may be withdrawn at any time.
8. Amendments, liability and complaints
8.1 The Promoter may amend these Terms and Conditions, or postpone, suspend or cancel the Raffle, only where reasonably necessary because of exceptional circumstances outside the Promoter’s reasonable control, to correct an obvious error, or to comply with a legal or regulatory requirement.
8.2 The Promoter will not make a change that materially disadvantages entrants who have already purchased a valid entry, unless the change is required by law or a competent regulator. Where a material change is necessary, the Promoter will take reasonable steps to notify affected entrants and will publish the revised Terms and Conditions on the Raffle webpage, showing the date on which they were updated.
8.3 If the draw date is changed, the Promoter will make reasonable efforts to notify entrants. If the Raffle is cancelled and no draw takes place, valid entry payments will be refunded to the original payment method where reasonably practicable.
8.4 The Promoter’s decisions concerning the administration of the Raffle and application of these Terms and Conditions will be final, subject to applicable law and the entrant’s right to raise a complaint or refer a matter to a competent regulator.
8.5 Questions or complaints about the Raffle should first be submitted to the Promoter at development@boh.org.uk or by post to the registered office address. The Promoter will investigate complaints fairly and retain an appropriate record of the complaint and its resolution.
8.6 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Subject to this, the Promoter is not responsible for loss or expense arising from use of a prize except where directly caused by the Promoter’s breach of these Terms and Conditions or negligence.
8.7 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.
All promotional materials relating to the Raffle should be read together with these Terms and Conditions. If there is any inconsistency, these Terms and Conditions will apply, subject to applicable law.
